86 <br /> PROPOSED ORDINANCE AMENDMENT <br /> ORDINANCE: SUBDIVISION REGULATIONS <br /> REFERENCE: IV-B-6 RESERVATION OF SPACE FOR UTILITIES <br /> ORIGIN OF AMENDMENT: Staff Planning Board <br /> x BOCC Public <br /> Other: <br /> STAFF PRIORITY RECOMMENDATION: _x_High Middle Low <br /> Comment: <br /> EXPECTED PUBLIC HEARING DATE: August 28, 1989 <br /> PURPOSE OF AMENDMENT: <br /> To permit dedication of water and sewer easements as a <br /> condition of approval for subdivisions within 10 or 20-Year <br /> Transition Areas. <br /> IMPACTS/ISSUES: <br /> Easements for public utilities to serve subdivisions are <br /> dedicated to the applicable utility provider, usually at the <br /> time of subdivision approval. It may be necessary for <br /> easements to be obtained from adjoining property owners in <br /> order for a new project to connect to existing facilities. <br /> Whereas public utilities have the power of eminent domain, <br /> efforts are made to avoid use of that power unless absolutely <br /> necessary. <br /> Subdivisions within 10-20 Year Transition Areas may utilize <br /> • public water and sewer facilities, as provided in the Orange <br /> County Water and Sewer Policy. However, use of public <br /> utilities is not required. Subdivisions within Transition <br /> Areas which utilize individual wells and septic tanks are not <br /> presently required to provide easements where public <br /> facilities will not be utilized in the subdivision itself. <br /> • This practice can create easement gaps which could create <br /> difficulties for future water and sewer extensions. <br /> This issue was raised by the Board of County Commissioners <br /> during approval of a preliminary plat on May 1, 1989, and was <br /> referred to the Planning Board for consideration. <br /> The proposed amendment would allow for utility easements as a <br /> requirement for subdivisions approved within designated <br /> • Transition Areas. This provision would facilitate more <br /> orderly extension of public facilities. <br />
