79 <br /> PROPOSED ORDINANCE AMENDMENT <br /> ORDINANCE: ZONING ORDINANCE <br /> SUBDIVISION REGULATIONS <br /> REFERENCE: ARTICLE 20.6 PUBLIC HEARING AND NOTICE THEREOF <br /> SECTION VII-D - AMENDMENT PROCEDURES <br /> ORIGIN OF AMENDMENT: Staff Planning Board <br /> BOCC Public <br /> x Other: County Attorney <br /> STAFF PRIORITY RECOMMENDATION: _x High Middle Low <br /> Comment: <br /> EXPECTED PUBLIC BEARING DATE: August 28, 1989 <br /> PURPOSE OF AMENDMENT: <br /> To consider an amendment to the public hearing regulations in the <br /> Subdivision Regulations and Zoning Ordinance to require that once <br /> opened, any public hearing remain open until a final decision is made <br /> by the Board of County Commissioners. <br /> IMPACTS/ISSUES: <br /> The testimony received at a public hearing is on record as information <br /> considered by the hearing body in rendering its decision. Testimony <br /> received outside of the public hearing may not be considered. <br /> The Board of County Commissioners often keeps a public hearing open <br /> after the initial hearing date if there are additional comments <br /> anticipated, or if additional information is to be submitted. The <br /> Planning Board may then received and review additional comments and <br /> information, and consider that input in making its recommendation. The <br /> Board of Commissioners makes a decision after receiving a <br /> recommendation from the Planning Board. <br /> The purpose of the proposed amendment is to assure that all information <br /> received prior to the decision of the Board of County Commissioners can <br /> be considered. If approved, the amendment would deem a public hearing <br /> as open, from the initial hearing date until the time of final <br /> decision. <br /> In order to allow for issues which arise during the hearing to be <br /> resolved, it is also proposed that the time limit for a recommendation <br /> of the Planning Board be extended from 30 days to 60 days. This would <br /> allow a proposal to be considered by the Planning Board at two <br /> consecutive meetings if necessary. The time limit would apply to <br /> applications submitted by the public, but not those initiated by Orange <br /> County. <br /> The amendments are proposed for inclusion in both the Subdivision <br /> Regulations and Zoning Ordinance to provide for consistency in <br /> procedures. <br />
