T <br /> whether the use of the permit would violate 59 <br /> contractual or other arrangements (including, <br /> but not by way of limitation, restrictive <br /> covenants) among private parties. <br /> e) The Zoning Officer shall revoke a zoning <br /> compliance permit if it is found to be issued <br /> in violation of any of the provisions of this <br /> ordinance, or if the conditions as stated on <br /> the permit are not carried out. <br /> f) If an application for such permit is <br /> disapproved, the Zoning Officer shall state in <br /> writing the cause for such disapproval. <br /> al The Zoning Officer, shall issue a Stop Work <br /> Order pursuant to Article, 23.2d if it is <br /> • determined that irreparable injury will occur <br /> if the alleged violation is not terminated, <br /> immediately., <br /> *23.2 Penalties <br /> • a) Criminal Action: <br /> *Amended Any person, firm, or corporation who violates the <br /> 10/3/88 provisions of this Ordinance or who fails to comply <br /> with any of its requirements shall, upon <br /> conviction, be guilty of a misdemeanor and shall be <br /> punished as provided in G.S. Section 14-4. <br /> b) Civil Penalty: <br /> Any act constituting a violation of any requirement <br /> of this ordinance shall subject the offender to a <br /> civil penalty of $100. No penalty shall be <br /> assessed until the person alleged to be in <br /> violation has been notified of the violation by <br /> registered or certified mail, delivery restricted <br /> to addressee only, return receipt requested, or <br /> other means reasonably calculated to provide actual <br /> notice to the offender. The notice shall describe <br /> the violation with reasonable particularity, <br /> specify a reasonable time period within which the <br /> violation must be corrected and warn that failure <br /> to correct the violation within the time period <br /> will result in the assessment of a civil penalty. <br /> In the event the violation is not corrected within <br /> the time period provided in the notice, the Orange <br /> County Board of Commissioners shall make written <br /> demand for payment upon the person responsible for <br /> the violation, and shall set forth in detail a <br /> description of the violation for which the penalty <br /> has been invoked. If payment is not received or <br /> equitable settlement reached within 30 days after <br /> demand for payment is made, the matter shall be , <br /> referred to the county attorney for institution of <br />
