PROPOSED ORDINANCE AMENDMENT 54 <br /> ORDINANCE: ZONING ORDINANCE <br /> REFERENCE: ARTICLE 2.3.3 BOARD OF ADJUSTMENT ADMINISTRATION <br /> ARTICLE 2 .4.1 PLANNING DEPARTMENT DUTIES AND <br /> RESPONSIBILITIES <br /> ARTICLE 21 ADMINISTRATION <br /> ARTICLE 23.2 PENALTIES <br /> ORIGIN OF AMENDMENT: Staff Planning Board <br /> BOCC Public <br /> x County Attorney <br /> STAFF PRIORITY RECOMMENDATION: x High Middle Low <br /> Comment: <br /> EXPECTED PUBLIC HEARING DATE: August 28, 1989 <br /> PURPOSE OF AMENDMENT: <br /> To consider an amendment to the Zoning Ordinance to authorize <br /> issuance of Stop Work Orders for alleged violations of the <br /> Zoning Ordinance. <br /> IMPACTS/ISSUES: <br /> A bill to amend G.S. 153A-123 to authorize a County to issue <br /> Stop Work Orders for violations of land use ordinances has <br /> been ratified. The legislation allows a Zoning Officer to <br /> issue a Stop Work Order if it is determined that irreparable <br /> injury would occur if an alleged violation is not terminated <br /> immediately. Amendment of the Zoning Ordinance is needed <br /> before the new legislation can be implemented. <br /> Procedure <br /> The stop work order would be posted on the property and the. <br /> alleged violator notified by certified or registered mail. <br /> The violator or property owner could file an expedited appeal <br /> to the Board of Adjustment. The Board would render its <br /> determination within 15 days of the notice of appeal (which <br /> could necessitate the calling of a special meeting) . Due to <br /> the expedited process, notification of adjacent property <br /> owners, posting of the property, and publication of the <br /> hearing notice would not be required. The violator and/or <br /> property owner would, however, be notified of the hearing <br /> date by certified mail. <br /> OMNIMImmommor <br />
