48 <br /> PROPOSED ORDINANCE AMENDMENT <br /> ORDINANCE: ZONING ORDINANCE <br /> REFERENCE: ARTICLE 22 - DEFINITIONS <br /> ARTICLE 6.3 - REGULATION OF PRINCIPLE USES <br /> ORIGIN OF AMENDMENT: x Staff Planning Board <br /> BOCC Public <br /> Other: <br /> STAFF PRIORITY RECOMMENDATION: High Middle _x_Low <br /> Comment: <br /> EXPECTED PUBLIC HEARING DATE: August 28, 1989 <br /> PURPOSE OF AMENDMENT: <br /> To amend definitions pertaining to uses, structures and <br /> buildings, and regulations pertaining to use of non- <br /> residential zoning lots. <br /> IMPACTS/ISSUES: <br /> As presently worded, Article 6.3 states "Except as permitted <br /> as part of a Planned Development, there shall be only one <br /> principle structure permitted per non-residential zoning <br /> lot. " A principle building is currently defined as "A <br /> building, or where the context so indicates, a group of <br /> buildings in which is conducted the main or principle use of <br /> the lot on which said building is situated. " <br /> It has historically been the interpretation of the Planning <br /> Department that more than one building may be permitted on a <br /> non-residential zoning lot without approval as a Planned <br /> Development, if all buildings are an integral component of a <br /> single principle use. The phrase "as the context so <br /> indicates" has been interpreted to refer to the context of <br /> the particular project. <br /> This interpretation has been questioned by the County <br /> Attorney, as being in conflict with the requirement in <br /> Article 6.3 that there be only one principle structure per <br /> non-residential zoning lot, except as permitted as part of a. <br /> Planned Development. <br /> The interpretation of the provisions determines whether or <br /> not site plans for certain facilities consisting of multiple <br /> buildings are approved at the staff level or by the Board of <br /> County Commissioners through the Planned Development public <br /> hearing process. <br /> egusonswer <br />
