45 <br /> (3) Any person who fails to submit an erosion control plan <br /> for approval pursuant to this Ordinance shall be subject <br /> to a single, noncontinuing civil penalty of one thousand <br /> dollars ($1,000) . Any penalty which is recovered pursuant <br /> to this subdivision shall be deposited in the General <br /> Fund. Any person who is subject to a civil penalty under <br /> this subdivision may be subject to additional civil <br /> penalties for any violation of any other provision of <br /> this Article or any Ordinance, or any, rule, or order <br /> adopted or issued pursuant to this Article Ordinance by <br /> the Commission or Orange County. <br /> COMMENTARY: The Commission's modification is to delete <br /> the second sentence and replace it with <br /> paragraph (4) below. <br /> The last sentence will be modified by <br /> deleting the struck-through text and adding <br /> the underlined text to ensure consistency <br /> with Section 22(a) (1) . <br /> (4) Civil penalties collected pursuant to this Ordinance <br /> shall be used or disbursed as directed by G.S. <br /> 113A-64(a) . <br /> COMMENTARY: Paragraph (4) would be added to conform with <br /> the language of the Model Ordinance as <br /> revised and to eliminate the internal <br /> inconsistency of the two deleted provisions. <br />
