44 <br /> alternative systems study, the McLennan's Farm request <br /> was inadvertently left off the June 21 Commissioners <br /> agenda. Since the public hearing was not continued to <br /> a date certain, the McLennan's Farm application <br /> expired. <br /> A new application was presented at the May 22 public <br /> hearing. However, the only new evidence submitted was <br /> information which clarified the ownership, operation, <br /> and maintenance of the proposed wastewater disposal <br /> system. The layout and design of the proposed resi- <br /> dential planned development remained the same. <br /> The public hearing was continued to the June 28 Board <br /> of Commissioners meeting to allow time for the <br /> Planning Staff and the County Engineer to meet with <br /> the applicant and obtain additional information on the <br /> adequacy of the proposed system for wastewater <br /> disposal. At the meeting, the County Engineer stated <br /> that he was satisfied that his concerns had been <br /> addressed following meetings with the applicant and <br /> through the conditions of approval included with the <br /> Planning Staff's recommendation. <br /> A memorandum from the Health Department regarding soil <br /> evaluations was also submitted at the hearing on June <br /> 28. A request had been made to the Division of Health <br /> Services for a copy of the soils report made by OHS <br /> Staff after visiting the McLennan's Farm site. This <br /> report has not yet been received, so the Health <br /> Department will have their own soil scientist submit a <br /> soils report. This report will be distributed at the <br /> meeting. <br /> The public hearing was continued to the August 1 <br /> Commissioners meeting to receive the Planning Board's <br /> recommendation and additional soils information. <br /> RECOMMENDATION: The Planning Staff recommends approval of the Planned <br /> Development/Special Use application for McLennan's <br /> Farm with the following conditions: <br /> 1. The grantee of this Special Use Permit shall post <br /> with Orange County, in a form acceptable to the <br /> County Attorney, a bond or letter .of credit in an . .. . . <br /> amount equal to the cost of all improvements plus <br /> ten percent (10%) . The amount shall be determined <br /> on the basis of fully executed construction <br /> contracts or certification by a registered <br /> engineer employed by the grantee of this ' Special <br /> Use Permit. As improvements are completed a <br /> corresponding amount of money may be released from <br /> the security instruments or the security <br /> instruments may be re-negotiated based on the "yet <br /> to do" portion of the improvements. <br /> 2.
