This proposed zoning change would carry out the intent
and purpose of the adopted land use in that it would
enhance the adopted plan. This change would address the
need for different activities other than residential
bordering 1-40 which could not only act as additional
buffer between 1-40 and the surrounding community but
also address the lack of consideration given to the
property impacted directly by 1-40.
4. We offer the following in support of this rezoning :
a. This site is located in an area which is not to be
served with public utilities (sewer and water) for
at least 20 years. Restrictions, therefore, would
be self imposing upon any development. Density and
intensity of development would be limited as a
result.
b. The proposed zoning change would correct the fact
that the existing zoning ordinance fails to
recognize negative impacts of an interstate highway
on adjacent properties. This- would be done by
giving the opportunity to allow for a reasonable,
acceptable usage of these negatively impacted
1 properties.
c. The proposed zoning parallels the existing zoning in
terms of uses. The only differences being that those
uses permitted in 'AR' district which are not
permitted in 'RBI district are further regulated by
requiring a special use permit.
• •
d. The initial impacts of noise that, the county
considered prior to the completion of 1-40 were in
error.. The actual size of the impacted area, and db
level, is greater than was anticipated.
•
