NLTNHQ 17 APRIL 1989 PAGE 1 <br /> 19 <br /> • <br /> The following are statements of justification addressing <br /> issues 1 through 4 as outlined on the attached Application for <br /> Change of Zoning District. <br /> 1. The Zoning Ordinance as it exists and the policies which <br /> generated and administer this ordinance as they exist are <br /> in error for the following reasons : <br /> a. The present zoning fails to recognize negative <br /> impacts of an interstate highway on adjacent <br /> properties and allow for a reasonable, acceptable <br /> usage of these negatively impacted properties. <br /> b. The present zoning violates fundamental principles <br /> of planning by not providing for a variety of <br /> residential services available to the residential <br /> areas. The present zoning does not allow for the <br /> orderly provision of services to support desired <br /> residential usage of the area. <br /> c. The proposed amendment will correct the error of the <br /> existing zoning by allowing functions other than <br /> residential use at a 1 per 2 acre density at this <br /> location. Residential use at this proximity to 1-40 <br /> is not practical and not desirable due mainly to the <br /> impact of sound from 1-40. Changing the zoning at <br /> this area would allow more flexibility in the use of <br /> this property. Also, the requested change would <br /> establish a descending hierarchy of uses from 1-40 <br /> to the lower residential densities. This hierarchy <br /> will provide an excellent transition from the <br /> intensity of 1-40. <br /> 2. The completion of the 1-.40 corridor is the, major change <br /> in the county that necessitates the rezoning. The <br /> present zoning fails to recognize the negative impacts of <br /> the interstate highway on the adjacent properties. The <br /> zoning as it exists does not allow for a reasonable, <br /> acceptable usage of these negatively impacted properties. <br /> This proposed change in zoning would not only give more <br /> reasonable alternatives to the impacted properties but <br /> also would establish a desirable transition between 1-40 <br /> and the surrounding community. This change would not <br /> result in additional negative impacts on public health, <br /> safety and general welfare and would result in an <br /> improvement on the present conditions. <br /> Wmammnmmumw <br />
