50 <br /> SECTION XI <br /> GRIEVANCE PROCEDURES <br /> 1. Formal Complaint <br /> If a Member is unable to resolve a problem informally, that person <br /> may file a Formal Complaint with the Chief Executive Officer of the <br /> Plan. A Formal Complaint must be in writing and must describe the <br /> matter causing the person's dissatisfaction. A Formal Complaint must be <br /> filed with the Chief Executive Officer of the Plan within ninety (90) <br /> days of the incident causing dissatisfaction. The Chief Executive <br /> Officer of the Plan will investigate the Formal complaint, reach a <br /> decision, and will report the same in writing within thirty (30) days to <br /> the Member. <br /> 2. Grievance Committee <br /> The Chief Executive Officer of the Plan's decision may be <br /> appealed, in writing, within thirty (30) days of the date of receipt of <br /> that decision, to the Grievance Committee of the Plan's Board of <br /> Directors. The Chairman of that Committee will schedule a hearing, to <br /> be recorded by a court reporter, either during the next regularly <br /> scheduled meeting of the Committee or at a special meeting called to <br /> consider the appeal, within thirty (30) days of the date he/she received <br /> notice of appeal. The Member and the Chief Executive Officer of the Plan <br /> may be represented by counsel, call witnesses, present evidence, and <br /> cross-examine opposing witnesses during the hearing. The Grievance <br /> Committee will render its decision within thirty (30) days after the <br /> hearing. <br /> 45 <br />
