• 5 <br /> litigation with Orange County over this particular matter. <br /> It has been our hope that some more innovative solution to <br /> some of these issues where we feel that we have been treated <br /> unfairly, could be developed in this process. With that in <br /> mind we made this application, and. of course, we made the <br /> application without prejudice to the things we were then <br /> engaged in with Orange County. But we are here, <br /> fundamentally, because the plan that was adopted in 1987 <br /> finally, does not permit a reasonable use of our property. <br /> We, as Mr. Zapoiski has told you, cannot reasonably in a <br /> constitutional sense use our property for anything. I <br /> sympathize with folks, I think there were chuckles when the <br /> suggestion that there were some buffering that could be done <br /> _between the interstate, some folks chuckled about that and I <br /> think the chuckles are a part of the fact that it is nice to <br /> have that buffer there now, it's nice to have that green belt <br /> . through there that other people own that protects you if you <br /> live further away from the interstate. The problem is there <br /> are people who own that greenbelt, including my client, and <br /> who think that they ought.. to have some reasonable use of <br /> their property and that's what we're trying to do here. The <br /> purpose, the reason we're here is to talk about a <br /> Comprehensive Plan change, but I don't want to hide the ball <br /> on anybody. We want to put a crush stone quarry on that <br /> property, that's why we want it rezoned AR, that's .what we've <br /> been after since 1983, when we first prospected on this <br /> property. The reason we want to be there is that there are <br /> roughly, in excess of 40 million tons of aggregate reserves <br /> on that property. That's a substantial amount of money. <br /> Those are valuable, natural resources-natural resources, by <br /> the way, that each of you use everyday, they're like gold and <br /> diamonds to us, they may look like a little prop to you but <br /> they are our gold and our diamonds and the reason we're here <br /> is that we desire to mine those valuable natural resources <br /> and we can't under the current classification. <br /> Mr. Carey: Mr. Phears, I would like to ask that you, this <br /> public hearing is not on the specific use that you plan to <br /> make of that property if the land use is changed, and I would <br /> like to ask you to limit your discussions and your comments <br /> to the applicability of land use change in that particular <br /> location. I may have omitted saying .earlier that we would <br /> like each person who speaks tonight to try to limit your <br /> presentation to 3 minutes, because we want to give everyone a <br /> . chance to speak who wishes to speak tonight, however, we will <br /> not shut you off to 3 minutes. We do want to hear everything <br /> you have .to say but we would like to ask you to make your <br /> - comments specific to the issue before this public hearing <br /> tonight. <br /> Mr. Phears: Well, I had anticipated, frankly, that some of <br /> the audience would raise the possibility of the quarry would <br /> be permitted, in fact, I think it is already been raised here <br /> so I assume that we're going to eliminate all the discussion <br />
