f___ <br /> DRAFT6 . . <br /> Presentation by Mary Scearbo. <br /> The property is located in Cedar Grove <br /> Township at the end of Lake Orange Road (SR <br /> 1323) . The preliminary plan was approved by <br /> the Board of County Commissioners on July 6, <br /> 1987, and included 27 lots on approximately <br /> 81 acres. Three phases were indicated on the <br /> Preliminary Plan. Phase A contained 2 lots, <br /> Phase B contained 14 lots, and Phase C <br /> contained 11 lots. <br /> A Final Plat for the first Phase of the <br /> subdivision was approved on June 20, 1988. <br /> Seventeen lots were created at that time, <br /> more than was required by the Phasing <br /> indicated on the Preliminary 'Plat. It was <br /> expected that the project could be completed <br /> in two phases rather than three. All of the <br /> requirements of Final Plat approval were met, <br /> including construction of a bridge over the <br /> Eno River. <br /> Immediately after the Final Plat for Phase A <br /> was recorded, a lawsuit was filed by an <br /> alleged partner, and a lien was placed on the <br /> property. The applicant was unable to <br /> maintain the prior schedule of development <br /> due to the difficulties encountered as result <br /> the lawsuit. <br /> The Preliminary Plat will expire on June 20, <br /> 1989, which is one year from the approval <br /> date for Phase A. The applicant has <br /> requested that the phasing shown on the <br /> preliminary plat be revised to allow an <br /> additional six months for approval of the <br /> second phase. The third phase would be <br /> approved by June 1990. <br /> At the time that Eno River Estates was <br /> ' approved, the Subdivision Regulations did not <br /> contain specific provisions fr -the <br /> scheduling of multi-phase subdivisions. - �1t <br /> was the practice of the Planning Department <br /> to allow 1 year between each Final Plat <br /> submittal. The proposed phasing plan would <br /> allow an additional six months for <br /> recordation of Phase 2, but would reduce by <br /> six months the time permitted for approval of <br /> Phase 3. <br /> Current regulations pertaining to subdivision <br />
