The applicant <br /> was unable to maintain the prior schedule of <br /> development due to the difficulties encountered as <br /> result the lawsuit. <br /> The Preliminary Plat will expire on June 20, 1989, <br /> which is one year from the approval date of the Final <br /> Plat for Phase A. The applicant has requested that <br /> the phasing shown on the preliminary plat be revised <br /> to allow an additional six months for approval of the <br /> second phase. The third phase would be approved by <br /> June 1990. <br /> At the time that Eno River Estates was approved, the <br /> Subdivision Regulations did not contain specific <br /> provisions for the scheduling of multi-phase <br /> subdivisions. It was the practice of the Planning <br /> Department to allow 1 year between each Final Plat <br /> submittal. The proposed phasing plan would allow an <br /> additional six months for recordation of Phase 2, but <br /> would reduce by six months the time permitted for <br /> approval of Phase 3. <br /> Current regulations pertaining to subdivision approval <br /> do address project phasing. The applicants request is <br /> consistent with the provisions of the Subdivision <br /> Regulations which allow a specific phasing schedule <br /> to be included as part of the Preliminary Plat <br /> approval. <br /> The Planning Board considered the revision on May 15, <br /> 1989 and recommended approval. <br /> RECOMMENDATION: The Administration recommends approval of the proposed <br /> Phasing Plan for Phases 2 and 3 of Eno River Estates, <br /> including aproval of the Final Plat for Phase 2 by <br /> December 31, 1989, and approval of the Final Plat for <br /> Phase 3 by June 30, 1990. <br />
