The preliminary <br /> plan was approved by the Board of County Commissioners <br /> on July 6, 1987, and included 27 lots on approximately <br /> 81 acres. Three phases were indicated on the <br /> Preliminary Plan. Phase A contained 2 lots, Phase B <br /> contained 14 lots, and Phase C contained 11 lots. <br /> A Final Plat for the first Phase of the subdivision <br /> was approved on June 20, 1988. Seventeen lots were <br /> created at that time, more than was required by the <br /> Phasing indicated on the Preliminary Plat. It was <br /> expected that the project could be completed in two <br /> phases rather than three. All of the requirements of <br /> Final Plat approval were met, including construction <br /> of a bridge over the Eno River. <br /> Immediately after the Final Plat for Phase A was <br /> recorded, a lawsuit was filed by an alleged partner, <br />
