4 <br /> requirements of NRCD, all applicable requirements of the General Statutes of <br /> the State of North Carolina and any other applicable laws and Executive Orders <br /> currently or hereafter in force. <br /> 3. Obli_ations of Recipient with Respect to Certain Third Par • <br /> Relations. NRCD shall hold the recipient responsible for complying with the <br /> provisions of this agreement even when the recipient designates a third party <br /> or parties to undertake all or any part of the program. The recipient shall <br /> comply with all lawful requirements of NRCD necessary to ensure that the <br /> program is carried out in accordance with the recipient's certifications, <br /> including <br /> Rule .0certification 1 Northa Carolina Emergenccyy�Shelter Grants responsibilities, <br /> Program. <br /> under Rule .. <br /> Administrative Rules, 15 NCAC 13Q. <br /> 4. Interest of Members, Officers, or Employees of the Recipient, Members <br /> of Local Governing Body, or Other Public Officials. No member, officer, or <br /> employee of the recipient or its agents, no member of the governing body of <br /> the locality in which the program is situated, and no other public official of <br /> such locality of localities who exercises any functions ,or responsibilities <br /> which respect to the program during his tenure or for one year thereafter, <br /> shall have any financial interest, either direct or indirect, in any contract <br /> or subcontract, or the proceeds thereof, for work to be performed in <br /> connection with the program assisted.under this agreement. Immediate family <br /> members of said members, officers, employees, and officials are similarly <br /> barred from having any financial interest in the program. The recipient <br /> shall incorporate, or cause to be in s rP� interest o pursuant to the purpose of <br /> subcontracts, a provision prohibiting <br /> this section. <br /> The assistance provided under this agreement shall not be used in payment <br /> of any bonus or commission for the purpose of obtaining NRCD approval of the <br /> application for such assistance, or NRCD approval of applications for <br /> additional assistance, or any other approval or concurrence of NRCD required • <br /> under this agreement or the North Carolina Emergency Shelter Grants Program <br /> Administrative Rules, with respect thereto; provided, however, that reasonable . <br /> fees 'for bona fide technical, consultant, managerial of other such services, <br /> other than actual solicitation, are not hereby prohibited if otherwise <br /> eligible as program costs. <br /> 5. Remedies. NRCD shall have grounds to carry out the actions described <br /> in 15 NCAC 13Q .0704 REMEDIES when it determines that program goals and <br /> objectives have not been met, that state or federal requirements have not been <br /> followed, or that grant funds have been improperly expended. <br /> 6. Access to Records Related to ESGP Activities The recipient will give <br /> NRCD, ADD and the Comptroller General, through any authorized representatives, <br /> access to and the right to examine all records, books, papers or documents <br /> related to the ESGP grant and will require the subrecipieat(s)• to provide the <br /> same access to and _the right to examine its records, books, papers or <br /> documents related to the ESGP grant. <br /> ESGP #118-2 (Revised 4/89) <br />
