1 � <br /> While local governments have a role in protecting WS•I. watersheds, it is � .` <br /> ultimately the responsibility of the Environmental Management Commission to protect <br /> the quality of Class WS-I waters. Since the proposed Amberly Subdivision is located <br /> in the University Lake watershed and University Lake is classified as Class WS-I, I <br /> find that the issuance of 'the subject permit will allow "urbanization" of the <br /> watershed, and therefore, will not be compatible with the requirements of the <br /> regulations. Accordingly, I am hereby denying your request for a nondischarge permit <br /> for the construction and operation of the subject wastewater treatment and disposal <br /> facilities for Amberly Subdivision in Orange County. My reasons are as follows: <br /> 1)' The construction of the subject wastewater treatment and disposal facilities <br /> and subsequent development of the subdivision are not in accordance with the <br /> requirement that the watershed remain in a natural and uninhabited or <br /> predominantly undevelope&(not urbanized) state; . -- - . . <br /> 2) This development will contribute to nonpoint sources of pollution in the <br /> watershed; <br /> 3) The development could significantly compromise the pristine quality of Morgan <br /> Creek; and <br /> 4) All of these factors could exacerbate the quality and eutrophic status of <br /> University Lake, particularity with regard to nutrient loading, which in turn <br /> would compromise the quality and use of the Lake as a drinking water source.. <br /> If this denial is unacceptable to you, you have the right to an adjudicatory <br /> hearing upon written request within thirty days following receipt of this denial. <br /> • This request must be in the form of a written petition, conforming to Chapter 150E of <br /> the North Carolina General Statutes, and filed with the Office of Administrative <br /> Hearings, P.O.
