• 2 <br /> The small section of this parcel in Orange County has <br /> not been subdivided, since the Rural Buffer <br /> designation and zoning requires a minimum lot size of <br /> two acres. The Durham subdivision plat shows that this <br /> Orange County portion would eventually be the rear and <br /> side yards for three lots which would have Durham <br /> County residences. <br /> The 1.45-acre section in Orange County would be <br /> undevelopable under any current Orange County <br /> ordinance requirements, due to setback constraints. <br /> The applicant is requesting that this 1.45-acre <br /> portion in Orange County be redesignated from its <br /> current Rural Buffer category to Ten Year Transition. <br /> This change would permit smaller lot sizes than <br /> the current two-acre minimum, and would enable <br /> the Orange portion of the tract to be subdivided <br /> in a manner consistent with the Durham County <br /> Montvale subdivision. <br /> At the Joint Planning Area public hearing on April 6, <br /> this item was presented for public comment. One <br /> person, the applicant, spoke in favor of the proposal. <br /> One person spoke against the proposed amendment. <br /> Since the time of the public hearing, both the <br /> planning boards and the governing bodies of the Towns <br /> of Chapel Hill and Carrboro have considered this <br /> proposal. <br /> The Planning Board of the Town of Chapel Hill <br /> recommended approval of the proposed amendment. The <br /> Planning Board of the Town of Carrboro has recommended <br /> denial of the proposed amendment. <br /> The Chapel Hill Town Council has voted to approve this <br /> proposed amendment, as have the Carrboro Board of <br /> Aldermen. <br /> On May 15, 1989, the Orange County Planning Board <br /> considered the proposed amendment and returned a <br /> unanimous favorable recommendation. Draft minutes of <br /> this meeting are attached. <br /> RECOMMENDATION: The Administration recommends approval of the <br /> proposed amendment as per the Planning Board <br /> recommendation. <br />
