NORTH CAROLINA <br /> LEASE OF SEWER PLANT SITE AND <br /> COUNTY FACILITY - <br /> THIS LEASE AGREEMENT, made and entered into this <br /> day of , by and between <br /> ( "Landlord" ) and <br /> WITNESSET H: <br /> 1. Premises. Landlord hereby leases to Tenant, and <br /> Tenant hereby leases from Landlord, all that certain Lot shown <br /> as "Field Area, - - on that map entitled ' <br /> in • County, (hereinafter <br /> . _ <br /> "premises" ) by - Registered Land Surveyor, <br /> dated and recorded in the Office of the Register <br /> of Deeds of ' in at page refer- <br /> ence to which is hereby made for a more particular description . • <br /> of same. <br /> • 2 . Sewer Facility. Subject to the terms and condi- <br /> tions set forth herein, the Landlord leases to the Tenant and <br /> the Tenant rents from the Landlord all and every part, whether <br /> classified as a fixture or as an item of personalty, of that <br /> plant, machinery and equipment (hereinafter "sewer facility" ) <br /> located in and upon the demised premises referenced above; <br /> provided that, <br /> TO HAVE AND. TO HOLD the premises and sewer facility <br /> upon the terms and conditions hereinafter set forth. <br /> 3. Term. The term of this lease shall commence on <br /> the 1st day of • and shall be perpetual; provided <br /> that this lease shall terminate at such time that the appropri- <br /> ate governmental authorities shall commence provision of sewer <br /> services to. the subdivision located in <br /> Lebanon Township, Durham County, North Carolina. <br /> II'. Rent. Tenant shall pay to Landlord annual rental <br /> • in the amount of $ payment for the first year being due and • <br /> payable upon the execution of this Agreement, and payment for <br /> subsequent years being due and payable on each anniversary of <br /> this Agreement. All rental payments shall be made to Landlord <br /> at its principal office in Durham, North Carolina, or at such <br /> other place as Landlord may designate in writing to Tenant. <br /> (a) . The said sewer facility shall at all times <br /> be and remain the sole and exclusive property of the <br /> Landlord.
