3 <br /> PROPOSED ORDINANCE AMENDMENT <br /> ORDINANCE: ZONING ORDINANCE <br /> REFERENCE: SECTIONS S42 THROUGH S47 - PERMITTED USE TABLE <br /> (RETAIL TRADE) <br /> ORIGIN OF AMENDMENT: x Staff Planning Board <br /> BOCC Public <br /> Other: <br /> STAFF PRIORITY RECOMMENDATION: High Middle x Low <br /> Comment: <br /> EXPECTED PUBLIC HEARING DATE: February 27, 1989 <br /> PURPOSE OF AMENDMENT: <br /> To combine sections of the Permitted Use Table to eliminate <br /> text duplication and permit "mail order houses" in <br /> association with retail trade establishments. <br /> IMPACTS/ISSUES: <br /> Sections $42 through S47 of the Permitted Use Table of the <br /> Zoning, Ordinance pertain to "retail trade" . In determining <br /> the appropriate zoning district for a retail use, the <br /> specific use proposed is not a factor other than to identify <br /> adverse impacts which might occur at building, lot, and <br /> zoning district boundaries as a result of the operation. In <br /> addition, the traffic generation characteristics of the use <br /> (low, medium, and high impact) are also evaluated. <br /> Sections S42 through S44 refer to "Retail Trade, Sales, <br /> Rental of Convenience Goods, Merchandise, and Equipment. . . " . <br /> Sections S45 through S47 refers to "Retail Trade, Sales and <br /> Rental of Durable Goods, Merchandise and Equipment. . . " . <br /> By adding the words "Durable Goods" to Sections S42 through <br /> S44, Sections 545 through S47 could be deleted. The proposed <br /> amendment would clarify the provisions and eliminate text <br /> duplication. <br /> Two other minor amendments are proposed. First, there is a <br /> typographical error in Section S43 of the Ordinance. Medium <br /> traffic generation should read 200-800 trips/day instead of <br /> 200-300 trips/day. Second, the words, "Including Mail Order <br /> Houses, " should be added following "Merchandise and <br /> Equipment. . . " . The proposed addition would address past and <br /> present concerns on the part of local businessmen as to <br /> whether retail trade included such operations. <br />
