NORTH CAROL.-- 7514 <br /> apsTELEPHONE 919-967-7383 <br /> Mary Scarbrough January 3, 1989 <br /> 306 Revere Road, <br /> Hillsborough, NC <br /> Dear Ms. Scarbrough: <br /> We are planning to establish an animal sanctuary that would <br /> include , among other things, kennels, a large animal holding <br /> facility, and wildlife rehabilitation areas. These facilities <br /> will address important needs for the entire county. We have been <br /> looking at property along Eubanks Road in Orange County as a site <br /> for this animal sanctuary. • <br /> In analyzing the provisions of the zoning ordinance re— • <br /> garding a Class B special use permit for kennels or riding <br /> stables/academies (Sec. 8.8. 11 ) , we believe that the category of <br /> a humane shelter fits well within the spirit of this provision <br /> with no substantive changes required. Section 8.8.11 deals with <br /> kennels, barns, exercise yards, riding arenas, pens, and related <br /> improvements" all of which are consistent with the facilities <br /> associated with a humane shelter , which may handle a variety of <br /> species of animals. <br /> • <br /> We believe that if the kennels, barns, or animal holding <br /> areas are appropriate for the species being housed, there are not <br /> substantive differences affecting public health or safety or <br /> rights of adjacent property owners so long as the requirements <br /> for the issuance of the special use permit pursuant to Section <br /> 8.8.11 are met. Indeed, at the Orange County Animal Shelter in <br /> Chapel Hill we routinely handle a variety of species of animals, <br /> including goats, owls, squirrels, etc. , without difficulty. <br /> We have enclosed a copy of Section 8.8.11 , which we have <br /> marked to reflect suggested changes in this section to clarify <br /> the applicability of this section to humane shelters. <br /> Thank you for your assistance in this matter .
