• 4 <br /> Class II - For persons owning or keeping animals for: <br /> A. Breeding, selling, boarding. <br /> • B. Selling and/or training guard or security <br /> dogs. <br /> C. Owning or keeping twenty (20) or more <br /> animals. <br /> The Planning Staff is proposing to define a Class i kennel <br /> consistent with the Class I Kennel Permit (Animal Control) <br /> and a Class II kennel consistent with the Class II Kennel <br /> Permit (Animal Control) . Class i Kennels would be permitted <br /> by right in certain residential (RB, AR, R1) and commercial <br /> (CC3, GC4, AS) zoning districts. Class II Kennels would be <br /> permitted in those same zones with approval of a Class B <br /> Special Use Permit. All kennels included under the current <br /> definition must be located in those zones and have Class B <br /> Special Use Permit approval. <br /> Additional Special Use Permit requirements (Class II Kennels <br /> only) include the following: <br /> Review and approval of the Site Plan and Building Plans . <br /> by the Department of Animal Control. <br /> Posting of a sign at the main entrance of the facility <br /> giving names, addresses and numbers of persons to be <br /> contacted in case of an emergency. <br /> Obtaining any Kennel permit required by the Orange <br /> County Department of Animal Control within 30 days of <br /> occupancy. Failure to obtain and maintain a required <br /> Kennel permit could result in revocation of the Special <br /> • Use Permit. <br /> This problem of inconsistency was brought to the attention of <br /> the Planning Department through the investigation of an <br /> alleged zoning violation. A boarding and breeding kennel was <br /> denied Special Use Permit approval due to impacts on the <br /> surrounding area. The owner eliminated the boarding <br /> operation, but maintains about 20 animals for breeding. The <br /> neighborhood impacts are not significantly different, yet <br /> breeding alone is not addressed. The "kennel" does meet all <br /> requirements of the Animal Control Ordinance, and does have <br /> an approved Class II Kennel permit. <br /> If the Ordinance is interpreted literally, then the breeding <br /> of animals is not permitted in Orange County, and all such <br /> activity would be in violation of the Zoning Ordinance, <br /> including that which has permit approval from the Department <br /> of Animal Control. <br /> If it is not the intent to exclude breeding kennels, from <br /> Orange County, then it is the recommendation of the Planning <br />
