The current definition of kennel refers <br /> only to domestic pets. The Society has submitted <br /> plans for an animal shelter which includes facilities <br /> for rehabilitation of birds and other wildlife. <br /> A question was raised at the public hearing on <br /> February 27 regarding applicability to existing <br /> kennels. <br /> Boarding kennels, which require a Special Use Permit <br /> under the existing Ordinance provisions, would also <br /> require a permit under the revisied provisions. Any <br /> existing Special Use permit would remain valid. If <br /> the facility were to be modified or expanded in the <br /> future, a new permit would be obtained. <br /> Breeding Kennels are not presently addressed in the <br /> Zoning Ordinance, but would require a Special Use <br /> Permit if the proposal is approved. Section 11.6 of <br /> the Zoning Ordinance states that "any (existing) use <br /> that would require a Special Use Permit under terms of <br /> this ordinance shall be deemed a conforming use. <br /> However, enlargement, replacement, or modification of <br /> such a use shall require a Special Use Permit as <br /> though it were a new use. " <br /> Thus any existing breeding kennels, or boarding <br /> kennels which have not received approval of a Special <br /> Use Permit, including any kennels which are currently <br /> in violation of the Zoning Ordinance will be deemed <br /> conforming. The permit requirements for the Class II <br /> Kennels shall apply only to those developed after the <br /> effective date of the ordinance revision. <br /> The Planning Board recommended approval of the <br /> proposed amendment on April 11, 1989. <br /> RECOMMENDATION: The Administration recommends approval of the <br /> proposed amendment per the Planning Board <br /> recommendation. . <br />
