The Eno-2 Commercial/Industrial Transition Area <br /> narrative contains the following statement in closing: <br /> 'New commercial and industrial uses should generally be <br /> confined to the areas south of the {Interstate 85 and U.S. <br /> 70} highways in order to reduce negative impacts on Eno River <br /> State Park. ' <br /> ' Given this specific statement, it is clear that the original <br /> 41% intent of the Plan was to protect the environmentally- <br /> C. sensitive northeast quadrant of the node by discouraging <br /> intensive land uses. <br /> In this context, the proposed amendment does not meet the <br /> provisions set out in Article 20.3.2 which require a Plan <br /> amendment to carry out the intent and purpose of the <br /> Comprehensive Plan and should therefore be denied. <br /> • 2) This amendment could have numerous potentially-adverse <br /> impacts on both the environmentally-sensitive Eno River State <br /> 1.4 <br /> Park and an equally sensitive Natural Areas Site. The nature <br /> of both these sites require protection of the surrounding <br /> • land use intensity - a process that this Plan amendment <br /> cannot ensure. <br /> 3) It is not clear that the provision of utility services <br /> from the City of Durham will reach far enough west to make <br /> service available to this site. The City's designated Future <br /> Growth Boundary is flexible as to interpretation and <br /> • certainly subject to change. But the fact remains that a <br /> technical interpretation of the Durham Plan does not show the <br /> proposed amendment area as being within the Durham plan area. <br /> For these reasons, this amendment appears to be inconsistent <br /> with the Plan in both intent and application.
