PAGE 8 <br /> 5- <br /> 1 Element designation of the property from Rural Residential to 20-year Transition. <br /> 2 <br /> 3 Comprehensive Plan amendments adopted for Eno Township on July 5, 1988 and staff- <br /> 4 initiated rezonings to promote consistency with the Land Use Element of the Plan would <br /> 5 have changed the zoning on Mr. Johnny Kennedy's property from GC-4, the classification <br /> 5 it has had since 1981, to EC-5. <br /> 3 The Staff analysis presented to the Commissioners at their January 3rd meeting <br /> 9 indicated this property was outside the activity node and was incorrectly zoned in <br /> 1981. The Staff proposed Zoning Ordinance Text Amendments that would broaden the <br /> 1 scope of the EC-5 district. Mr. Kennedy was not pleased with this suggestion and was <br /> 2 instructed to meet with the Planning Staff to discuss alternatives. At that meeting <br /> 3 an amendment to the Land. Use Element of the Comprehensive Plan was identified as the <br /> 4 only alternative which would provide consistency between the Zoning Atlas and the <br /> 5 Comprehensive Plan. Mr.Kennedy indicated his approval of this suggestion. The <br /> ; proposed amendment would enlarge the existing 20-Year Transition Area that abuts the <br /> 7 area on the south and which includes the other three quadrants of the U.S. 70/1-85 <br /> 3 interchange. Property other than that owned by Mr. Kennedy is included in the <br /> 3 proposal, since it adjoins the access road which parallels U.S. 70 and 1-85, is in the <br /> 0 path of Durham's urban growth corridor, and would result in a uniform expansion of the <br /> 1 Transition Area to the south. <br /> 2 ' • <br /> 3 QUESTIONS OR COMMENTS FROM THE COMMISSIONERS OR PLANNING BOARD <br /> 4 • <br /> 5 -- Commissioner Hartwell indicated that, there appears to be a used car lot on this <br /> 6 property and requested clarification as to- its- exact location 'ofthe parcel the cars <br /> 7 are• locatedon.. ::' <br /> . _ _ <br /> 3 • • " 74 " • <br /> 9 :.17,::::., Mr,"Stancil indicated that. there. is a residential use near the corner of Pleasant <br /> 0 Gieen. ' He was not aware of the presence <br /> 2 of a used car operation. There are some commercial uses across Pleasant Green Road <br /> 3 Zsuch as Bull City Radiator. <br /> . <br /> • <br /> 5 . Commissioner Halkiotis stated that Mr. Kennedy does not repair school buses, but <br /> 6 .. sells parts to school systems to repair their own buses. That is the mail order <br /> 7 : component of the operation.. . There are seven or eight automobiles and trucks parked in <br /> 3 - the driveway area as you approach Mr. Kennedy's property. <br /> 9 <br /> 3. ' THE PUBLIC HEARING WAS OPEN FOR CITIZENS COMMENTS. <br /> 2 - Mr. Kennedy airified that he does have a small used car operation which started <br /> 3 out as bus sales but that the Insurance Commissioner stopped that business due to the <br /> 4 - fact that churches and private institutions are unable to afford the cost of insurance <br /> 5 - on their buses.'. The used car lot is to recoup part of the money he was receiving from <br /> the used and new bus sales. <br /> 7 . • <br /> . . • <br /> _ • -- - - <br /> 6 Kennedy stated that he met with Mr. Collins and his staff about the proposed <br /> 9 changes. ' They agreed with him that the County was in error in thinking that Laural <br /> 3 Ridge. Road was a private road rather than a public service road which is part of <br /> 1 Highway 70. When he got a building permit to build his building he had to go to DOT <br /> 2 and give them copies of plans showing that Laural Ridge Road is part of Highway 70 and <br /> 3 serves as a service road to that tract of land. Mr. Collkn's office admits there was <br /> 4 an error. Kennedy stated he tried to this error corrected last summer. He asked that <br /> 5 <br /> 7 <br /> 3 <br />
