J <br /> 8 <br /> Inventory due to rich, mesic forests and natural sites. <br /> However, a 150-foot Duke Power easement and overhead electric <br /> power transmission line bisects the proposed Transition Area. <br /> Given the presence of the power line easement and buffer <br /> requirements applicable to planned developments, the impact <br /> of the proposed development may be negligible. <br /> Furthermore, a historic cemetery is located on or near the <br /> property. The 1988 Inventory of Sites of Cultural, Historic, <br /> Recreational, Biological and Geological . Significance in the <br /> Unincorporated Portions, of Orange County references a family <br /> cemetery from the period 1836-1905 that is located on the <br /> north side of Old N.C. 10 0.2 miles west of University <br /> Station Road. The document states that this is "a small <br /> family cemetery. . .situates in a field, marked by a clump of <br /> sassafras and redbud trees. The trees and a dense undergrowth <br /> of honeysuckle, periwinkle and brambles totally obscures the <br /> headstones. Large slave cemetery supposedly situated on <br /> nearby hillside." This slave cemetery, if it exists, could <br /> also be located on the property in question. <br /> AGENCY COMMENTS <br /> No written agency comments were received on this <br /> amendment. The only agency verbally commenting on this <br /> amendment was the N.C. Department of Transportation. <br /> Assistant District Engineer Pat Ivey stated that the <br /> Department's previous comments submitted in August 1988 were <br /> still applicable. <br /> RECOMMENDATION <br /> Approval of the proposed Comprehensive Plan amendment is <br /> recommended for the following reasons: <br /> 1. The proposed amendment is consistent with the <br /> application requirements of a Land Use Element amendment. A <br /> strong case can be made for the changing, transitional nature <br /> of this area in Eno Township which lies between the two major <br /> interstate highways of 40 and 85. There are significant <br /> examples of transition away from rural, agricultural uses in <br /> the area to low and moderate density residential uses in the <br /> immediate vicinity, •and the proposed location of a new <br /> elementary school at New Hope Church Road and New N.C. 86 is <br /> further testimony to that fact. Using the definition of <br /> Transition Area from the Land Use Element, this proposed <br /> amendment appears to be consistent with the intent and <br /> purpose of the Comprehensive Plan. <br /> 2. The proposal complies with seven of the 11 location <br />
