1
I.
ORANGE COUNTY
BOARD OF COMMISSIONERS
Action Agenda
Item No.( -1
ACTION AGENDA ITEM ABSTRACT
Meeting Date: May 1 , 1989
SUBJECT: Senate Bill 339, An Act to Establish Uniformity in the Regulation
of Roadside Hunting.
DEPARTMENT: Manager PUBLIC HEARING YES: NO: X
ATTACHMENT(S) : Letter from INFORMATION CONTACT: Manager 's Office
Senator Hunt X501
TELEPHONE NUMBER-
Hillsborough - 732-8181
Chapel Hill - 968-4501
Mebane - 227-2031
Durham - 688-7331
PURPOSE: To respond to Senate Bill 339, An Act to Establish Uniformity in
the Regulation of Roadside Hunting.
BACKGROUND: SB 339 attempts to provide a statewide uniform standard to
the issue of roadside hunting. At present there are over 10
local Acts, including Orange County's. This multiplicity has
created confusion for hunters, wildlife officers and the
public. At the February 6th Board meeting, Commissioners
commented that laws on roadside hunting needed greater clarity
of purpose and stronger enforcement.
RECOMMENDATION(S) : The Manager recommends that the Board endorse SB 339
with one change; the deletion of the first phrase under
paragraph (b) of section 113-291 .9 as follows: "Unless a
person owes or possesses a leasehold interest in real property
situated on either side of the road or highway. . . " . The
point being made is that roadside hunting should and would be
unlawful regardless of property ownership.
