9 <br /> EEnEIV 7' <br /> V <br /> OW= U <br /> February 3, 1989 <br /> Page 1 of 2 <br /> Orange County Planning Department <br /> 306 Revere Road <br /> Hillsborough, NC 27278 <br /> RE: Justification for private road in Forest Knolls Subdivision <br /> An 8 lot subdivision totalling 35.91 acres located on the west side of <br /> Dodson's Crossroads between Hwy. 54 and Dairyland Road <br /> To Whom It May Concern: <br /> The following points were given careful consideration for justification of and <br /> compliance with private road standards as contained in article IV-B-3-D-1 in <br /> the Orange County Subdivision Ordinance specifically requesting permission for <br /> a private road within the subject subdivision. <br /> The location of the subject subdivision is in Bingham Township and is generally <br /> considered to be a rural location. It is the wish of the owner of the <br /> subdivision to retain the rural character of the natural environment while <br /> ensuring the privacy of the residents. The physical design of the subdivision <br /> clearly preserves the rural character of Orange County as follows: <br /> A) The restrictive covenants and design standards provide for lot sizes <br /> and building setbacks which are much greater than those required by the <br /> ordinance as shown on plat. As noted, there is a retention of all the <br /> existing vegetation and foliage on the west side of Dodson's Crossroads <br /> back into the subdivision of a minimum 380 linear feet from the center <br /> line of Dodson's Crossroads which is used as a natural screen of the <br /> subdivision from Dodson's Crossroads which maintains the natural wooded <br /> , and forested character along the existing public road and shall be <br /> '4 . preserved in it's natural state through the restrictive covenants. <br /> B) The restrictive covenants specifically address the intent to maintain <br /> as much as possible existing and natural vegetation within the <br /> subdivision, thus screening from public view the individual homes by <br /> strictly maintaining the wooded and forested character of the local <br /> environment. <br /> C) The restrictive covenants as noted will prevent further subdivision of <br /> the property . <br />
