2 <br /> of the proposed lots. <br /> The applicant has submitted a private road justifica- <br /> tion for a new Class B private road to access the 8 <br /> lots. A draft Road Maintenance Agreement and prelimi- <br /> nary restrictive covenants were also submitted as part <br /> of the justification for the private road. The written <br /> justification and the Planning Staff's evaluation of <br /> it are included in the agenda. Based on the character <br /> of the area in addition to the design features <br /> included in the subdivision, the Planning Staff has <br /> concluded that a Class B private road would be <br /> appropriate on this site. The roads in The Trails are <br /> the only public paved subdivision roads in the area. <br /> The roads in Sunnyfield, Pickards Mountain, Western <br /> Park, Five Forks, Twin Streams, and Covered Bridge are <br /> private and unpaved. <br /> The preliminary plan for Forest Knolls has been <br /> reviewed by all applicable agencies. Their comments <br /> are attached. NCDOT has approved the sight distance <br /> for the entrance road. Orange Soil and Water <br /> Conservation Staff has reported soils subject to <br /> flooding located along the perennial stream. These <br /> soils will be prohibited for development because they <br /> are included in the Land Use Buffer as shown on the <br /> preliminary plan. <br /> Orange County Environmental Health has indicated that <br /> each lot has tentative site approval for septic <br /> systems. However, lot 1 may need to use minimum <br /> setbacks in order to accommodate a house, well, and <br /> a septic tank. <br /> On April 17, the Planning Board recommended approval <br /> of the preliminary plan for Forest Knolls with a Class <br /> B private road and the following conditions: <br /> 1. Include in the restrictive covenants <br /> protection of existing vegetation, prohibition <br /> of further subdivision, 50 and 30-foot setbacks, <br /> and the minimum required setbacks for lot 1. <br /> 2. On the final plat, change the date to 1989, and <br /> dedicate the 5 feet of additional right-of-way <br /> and the 10' x 70' sight triangles on Dodsons <br /> Crossroads. <br />
