MEMORANDUM 103 <br /> TO: CARRBORO BOARD OF ALDERMEN <br /> ORANGE COUNTY BOARD OF COMMISSIONERS <br /> CHAPEL HILL TOWN COUNCIL <br /> CARRBORO TOWN MANAGER <br /> CHAPEL HILL TOWN MANAGER <br /> ORANGE COUNTY MANAGER <br /> FROM: CARRBORO PLANNING STAFF <br /> ORANGE COUNTY PLANNING STAFF <br /> CHAPEL HILL.PLANNING STAFF <br /> SUBJECT: Proposed Amendment to the Joint Planning Land Use Plan Map to <br /> Remove the 400 foot Rural Buffer Designation Between Carrboro's <br /> Transition Area I I and the Duke Forest Blackwood Division,and <br /> Include This Area in Carrboro's Transition Area II <br /> DATE: March 30, 1989 <br /> REQUEST: THE TOWN OF CARRBORO HAS REQUESTED THAT THE 400 FOOT RURAL <br /> BUFFER AREA LOCATED BETWEEN CARRBORO'S TRANSITION AREA II AND DUKE <br /> FOREST BE REMOVED,AND THAT THAT AREA BE DESIGNATED AS TRANSITION <br /> AREA II ON THE JOINT PLANNING LAND USE PLAN MAP. <br /> Since the Joint Planning Agreement became effective on November. 14, 1988, the <br /> Town, the County,and property owners have encountered difficulties in <br /> administering the provisions of the Joint Planning Agreement at the northern <br /> boundary of Carrboro's Transition Area II near Duke Forest. The'reason for these <br /> difficulties stems from the 400 foot strip of Rural Buffer zoning,under County <br /> control, that was left between Carrboro's Transition Area II and Duke Forest lands <br /> in this area,as a result of the County Commissioners'decision following the June <br /> 30, 1988 joint public hearing. (See figure 1). The 400 foot strip of County <br /> jurisdiction effectively means that owners of properties that abut Duke Forest in <br /> this area must seek two separate approvals in order to subdivide their tracts. In <br /> order to ameliorate the difficulties that have arisen in dealing with this situation, <br /> the Town administration is requesting an amendment to the Joint Planning Land <br /> Use Plan Map. The Town is requesting that the Map be amended to remove the <br /> 400 foot Rural Buffer buffer in this area and replace it with Transition Area II <br /> designation, which will then have to be zoned Carrboro R-R (one dwelling unit per <br /> acre) in a separate action. Where the Duke Forest property adjacent to the new <br /> Transition Area II contains areas of particular natural significance, and where the <br /> proposed County designation for Duke Forest is Public Interest District I,the Town <br /> proposes that there be kept a 100 foot undisturbed naturally vegetated setback <br /> 1 <br /> • <br />
