(OC) <br /> Not applicable. The property is not in Southern Triangle. <br /> 5) Duke Forest tracts will not be developed over the period <br /> 1980-2000. (OC) <br /> Not applicable. Duke Forest tracts are not involved and the <br /> property does not border Duke Forest tracts in Orange County. <br /> AGENCY COMMENTS <br /> The only comments received were from the Durham City- <br /> County Planning Department. Keith Luck, Principal Planner for <br /> that agency, states that both Rural Buffer and Ten Year <br /> Transition are compatible with the Durham Plan, and that the <br /> proposed amendment and its accompanying land use is <br /> acceptable. These comments are attached. <br /> RECOMMENDATION <br /> This proposed amendment is very different from most <br /> amendments in that it 1) will not change the existing land <br /> use on site because of the nature of the land; and 2) <br /> requires special consideration because it involves not only <br /> the planning efforts of the three jurisdictions that comprise <br /> the Joint Planning process, but adds a fourth entity - that <br /> of the City and County of Durham. <br /> For this reason, it is difficult to evaluate this proposal <br /> with a literal interpretation of the Joint Planning rules and <br /> regulations. On the one hand, it is clear that the Joint <br /> Planning Land Use Plan and text does not recommend that the <br /> Rural Buffer concept be altered in any way that would <br /> compromise the goals of this designation. <br /> On the other, this literal interpretation does not recognize <br /> the fact that the plan may be altered without damaging the <br /> concept. In this case, the proposal is that a 1.45-acre <br /> section of a tract, which contains a platted and developed <br /> Durham subdivision on its remainder, be given a designation <br /> 10 <br />
