7 ) <br /> This provision is not applicable. <br /> b. The creation of new activity nodes or <br /> additions to existing activity nodes which <br /> exceed ten (10) acres in land area; or <br /> This provision is not applicable. <br /> c. Proposals for new freestanding plan areas or <br /> additions to existing areas that exceed one <br /> hundred (100) acres in land area. <br /> The proposed amendment is functionally not a <br /> freestanding plan area, as it is directly and <br /> inevitably related to activity nodes and <br /> transition areas located in Durham County. <br /> Therefore, this provision is likewise not <br /> applicable. <br /> Amendments to be classified as secondary amendments include: <br /> a. The expansion of an activity node where the <br /> additional area is contiguous to an existing <br /> node and does not increase its land area by <br /> more than ten (10) acres; <br /> This provision does not apply. <br /> b. The expansion of a designated plan area where <br /> the additional area is contiguous to the <br /> existing plan designation and does not <br /> increase its land area by more than one <br /> hundred (100) acres. <br /> This proposed amendment can be considered as <br /> an expansion of a designated plan area as per <br /> the Durham 2005 Comprehensive Plan. In this <br /> plan, it can be clearly seen that the area of <br /> Durham County adjacent to this 1.45-acre <br /> Orange County sliver is classified for land <br /> uses that translate into Orange County's <br /> designation of Ten Year Transition or <br /> Commercial Activity Node. The bulk of the land <br /> in this vicinity is shown on the Durham Plan <br /> as "Residential, Up To 6 Units/Acre." Given <br /> the special circumstances of this request <br /> (with 94 percent of the tract in Durham <br /> County), consideration of this property as an <br /> t <br /> extension of Durham County land use seems <br /> appropriate where it would not otherwise. <br /> c.
