6S
Mr. Brad Torgan
September 29, 1988
Page 2
Due to a fluke of geography, Kerley Road does not
align with the County line. Thus, the resultant sliver
of land has a different zoning category (Rural Buffer)
from the majority of the original piece of property
(R-20) . In Durham County, the R-20 designation permits
30,000 square foot lots for lots served by' public sewer.
At Montvale, the lots are all 30,000 square feet or
larger.
In a practical real-life sense, the Montvale
Subdivision is experienced as a Durham County
• subdivision. Only 6% of the land area of Montvale is
located in Orange County. And in fact, the history of
tax payments for the entire parcel reveal that taxes have
always been paid exclusively to Durham County.
For the reasons stated above, we believe that the
entire subdivision should be zoned consistant with Durham
County zoning.
Sincerely,
• "
Carol Ann Are
• President •
Cazwell, Inc.
• CAZ/sw
• Enclosures
•
