1 i .r <br /> 106 <br /> • These proposals to amend the PID district come out of negotiations between the <br /> County and Duke University over the future of the Duke Forest properties. The • <br /> proposals have raised additional questions about the need for the 400 foot Rural <br /> Buffer buffer. If the long term plan for those Duke Forest properties includes <br /> residential development,and not preservation in an undeveloped state,and that is <br /> supported by the County,then the 400 foot Rural Buffer buffer north of Carrboro's <br /> Transition Area II is not necessary. The difficulties experienced by everyone <br /> involved in its administration can be avoided by removing it from the Land Use <br /> • Plan and including it in Transition Area II designation. If it is felt that a buffer of <br /> some sort is necessary between the Transition Area II and Duke Forest areas <br /> designated PID-I,a 100 foot naturally vegetated setback can be left along the <br /> property boundary,as was suggested at the June 1988 Joint Public Hearing. <br /> Requiring that a 100 foot undisturbed natural setback be retained along the <br /> Transition Area II property boundaries adjacent to Duke Forest properties • <br /> designated ND-I should cause no unreasonable hardship to property owners in <br /> the area, given the provisions of Carrboro's Land Use Ordinance. Section 15-123 <br /> (b)of the Ordinance states that if a preexisting property is made undevelopable <br /> because setback requirements cannot be met,then the entity issuing a land use <br /> permit may allow deviations from the setback that causes the problem. In <br /> addition,the properties that would be affected by this provision are already made <br /> nonconforming by the presence of Rural Buffer zoning,since they are less than <br /> 80,000 square feet in size. <br /> • <br /> • <br /> 3 <br />
