Collins responded, that's part of <br /> it. Jacobs continued "may in the first sentence <br /> makes sense. In the second sentence it seems to me <br /> that, if the only exception is public health <br /> emergencies, that it should say that 'as a basis for <br /> its financial participation in the utility system <br /> extension, except in cases of public health <br /> emergencies, the County shall attach conditions' . <br /> That seems to be even more basic to the whole issue <br /> of why we wanted to hold title is to insure that the <br /> extensions were consistent with the plan. If we <br /> give up title, then we have obviously given up any <br /> future recourse other than any conditions that were <br /> attached that make sure that it is consistent with <br /> the Comprehensive Plan. Collins responded "I <br /> understand your point. I think one of the things <br /> that I would say in response to that is during this <br /> process of revising the policy, one of the things <br /> that the County Attorney pointed out is that if this <br /> is approved by the Commissioners, that's all it is, <br /> is a policy. In order to put the policy into effect <br /> what we need to do is come back with ordinance <br /> amendments to implement it. One of the things that <br /> we would seek to address in terms of those ordinance <br /> amendments, to get back to the preceding section on <br /> development patterns, is looking at strengthening <br /> the concept of public water and sewer in transition <br /> areas and to extend outside could do so with these <br /> stipulations. Once the ordinance is on the books, I <br /> think it gives the County the control it needs to <br /> provide for extensions consistent with the Plan. I <br /> don't know that changing that second 'may' to shall <br /> is necessary if we follow through with implementing <br /> the ordinances. Again, it may be that we simply do <br /> not want to attach conditions or it's not even <br /> necessary because of the ordinance controls. By <br /> putting 'shall' in there, we lock ourselves in to <br /> having to set conditions on each and every extension <br /> that we might be financially involved in. And, <br /> again, the question is one of flexibility not only <br /> for us but for the others as well. " <br /> Jacobs asked "Are you going to give a report to the <br /> Commissioners? Is it on their agenda?" Collins <br /> responded "it is on the agenda. What we are seeking <br /> to do is to get their comments. This revised draft <br /> has been reviewed with MC, Town of Chapel Hill, <br /> Town of Carrboro, Town of Hillsborough and. OWASA and <br /> comments have been received from all of them; They <br /> have all been pretty pleased but they still have <br /> some concern but as related to what we had before, <br />
