GENERAL ASSEMBLY OF NORTH CAROLINA SESSION 1989 18 <br /> 1 operate or maintain its public transportation system, to remove <br /> 2 or relocate such installation, structures, eouipment, apparatus, <br /> 3 appliances or facilities from their locations. <br /> 4 (b) If the owner or operator thereof fails or refuses to remove . <br /> 5 or relocate them, the Authority may proceed to do so. The <br /> 6 Authorit ma provide the necessary new locations, and for that <br /> 7 purpose the power of eminent domain as provided in G.S. 160A-619 <br /> 8 may be exercised Provided the new locations shall not be in, on <br /> 9 or above , a public way; the Authority may also acquire the <br /> 10 necessar new locations b purchase or otherwise . <br /> 11 (c) The Authorit shall reimburse the public utilit , railroad <br /> 12 or other public service corporation, for the cost of relocations <br /> 13 which shall be the entire amount paid or incurred by the utility <br /> 14 properly attributable thereto after deducting the cost of any <br /> 15 increase in the service capacity of the new installations„. <br /> 16 structures, eouioment, apparatus, appliances or facilities and <br /> 17 any salvage value derived from the old installations , structures , <br /> 18 eouipment, apparatus or appliances. " <br /> 19 Sec. 2. G.S. 159-81(1) reads as rewritten: <br /> 20 "(1 ) 'Municipality' means a county, city, town, incorporated <br /> 21 village, sanitary district, metropolitan sewerage district, <br /> 22 metropolitan water district, county water and sewer district, <br /> 23 water and sewer authority, hospital authority, hospital district, <br /> 24 parking authority, special airport district, regional public <br /> 25 transportation authority, and airport authority, a joint agency <br /> 26 created pursuant to Part 1 of Article 20 of Chapter 160A of the <br /> 27 General Statutes, but not any other forms of local government. " <br /> • 28 Sec. 2. 1 . G.S. 159-44( 4 ) reads as rewritten: 0 <br /> 29 " ( 4 ) 'Unit, ' unit of local government. ' or ' local government' <br /> 30 means counties; cities, towns, and incorporated villages; <br /> 31. sanitary districts ; mosquito control districts; hospital <br /> 32 districts; metropolitan sewerage districts; metropolitan water <br /> 33 districts; county water and sewer districts ; regional yublic <br /> • 34 transportation authorities ; and special airport districts.
