13 <br /> EMERGENCY SHELTER GRANTS PROGRAMS <br /> • <br /> LOCAL GOVERNMENT CERTIFICATION FORM <br /> The Applicant, County of Orange , certifies that: <br /> (Name of Local Government) <br /> (a) The matching supplemental funds required by the regulations at 24 CFR <br /> 576.71 will be provided. A description of the sources and amounts of <br /> such supplemental funding is provided in this application. • <br /> (b) It possesses legal authority to apply for the grant, and to execute to <br /> execute the proposed program. <br /> (c) Its governing body has duly adopted or passed as an official act a' <br /> resolution, motion or similar action authorizing the filing of the <br /> application, including all understandings and assurances contained <br /> therein, and directing and authorizing the person identified as the <br /> official representative of the applicant to act in connection with the <br /> application and to provide such additional information as may be <br /> required. <br /> (d) Its chief elected official or other officer of the applicant approved <br /> by NRCD: <br /> • <br /> (1) Consents to assume the status of the "responsible Federal <br /> Official" as that term is used in Section 102 of the National <br /> Environmental Policy Act (NEPA), and other provisions of Federal <br /> law, as specified at 24 .CFR 58.5, which further the purpose of <br /> NEPA. <br /> (2) Is authorized and consents on behalf <br /> of the applicant and himself <br /> to accept the jurisdiction of the Federal courts for the purpose <br /> • of enforcement of his responsibilities as such an official. <br /> (3) Consents to review and comment on all Environmental Impact. <br /> Statements prepared for Federal projects which may'have an impact <br /> on the applicant's/recipient's ESGP Program. <br /> (4) Consents to perform all coordination functions required under 24 <br /> CFR 58 and 40 CFR 1500-1508. <br /> (e) Its ESGP program will be conducted and administered in conformity with <br /> Public Law 90-284, and that it will affirmatively further fair housing. <br /> (f) It will comply with and ensure that designated subrscipients of .ESGP <br /> grants will comply with and ensure that designated subrecipients of <br /> ESGP grants will comply with all provisions of 15NCAC 13Q of the North <br /> Carolina Administrative Code, entitled Emergency Shelter Grants <br /> Program, and all applicable federal and state laws, regulations, rules <br /> and Executive Orders. <br /> ESGP #104-1 (Revised 3/89) <br />
