C. <br /> Dear Sirs: <br /> In November of 1984, acting as agent for John M. Durner and <br /> Samuel W. Durner, I sold a parcel of land containing approximately <br /> 10.14 acres to John R. Kennedy and wife, Helen W. Kennedy. This <br /> property is located at the Northeast intersection of 1-85 and 410 <br /> Highway 70 in Orange County. The land at that time was zoned by <br /> the Orange County Planning Board as General Commercial, GC-4. <br /> Mr. and Mrs. Kennedy purchased the property in good faith, assuming <br /> that they could conduct their business and expand it in the future, <br /> if the opportunity presented itself, since this would be allowed <br /> under the permitted uses in a GC-4 zone. <br /> The Orange County Planning Board proposes to down zone the <br /> Kennedy property from GC-4, General Commercial zone to a EC-5, <br /> Existing Commercial zone. Under- a EC-5 zone, there are approximately <br /> 31 less permitted uses of the property than under a GC-4 zone. It <br /> is my understanding that the Kennedys will not be permitted to expand <br /> their present business under the EC-5 zone. I believe to down zone <br /> this property would drastically reduce the value of the property <br /> and restrict its resale potential. <br /> In my opinion, the highest and best use of this property is <br /> best represented under a GC-4 zoning. <br /> Very truly yours, <br /> James W.
