• <br /> y r <br /> • <br /> • 091 <br /> there exists some question as to the compliance of the <br /> Flora/Fauna, Agriculture/Forestry and Historic/Cultural <br /> sections, measures of mitigation are available to minimize <br /> negative impacts on the natural areas within Eno River State • <br /> Park. <br /> 2) This amendment is located in an area where significant <br /> transition to non-residential uses has already occurred. One <br /> of the three tracts involved in the amendment is currently <br /> a non-residential use. The area is located along a statewide <br /> Strategic Corridor at its intersection with another major <br /> thoroughfare. In addition, Pleasant Green Road is scheduled <br /> at some point in time to be upgraded to major thoroughfare <br /> status, and the Durham Outer Loop may pass nearby, creating <br /> another interchange with the Interstate. Furthermore, the <br /> provision of, water/sewer services from the City of Durham <br /> appears to be a very real possibility for the future. <br /> In light of these factors, a strong case can be made <br /> that the area is indeed the "area of transition" that the <br /> proposed amendment would designate. <br /> 3) The proposed amendment is consistent with the intent and <br /> purpose of the Land Use Element of the Comprehensive Plan. It <br /> represents a means of allowing limited development on an <br /> interstate quadrant that is in relatively-close proximity to <br /> sensitive natural features. The Land Use Element of the Plan <br /> seemed to have this type of compromise in mind when it <br /> recommended that commercial/industrial development should <br /> generally be steered on the south side of the interchange <br /> area. Since this is an amendment to the Land Use Element, and <br /> not an amendment .to the zoning or development regulations, <br /> this proposal in itself will not physically impact the <br /> surrounding properties. Any new development in this area <br /> would be required to conform to the regulations and <br /> protective measures of the Orange County Zoning Ordinance. <br /> Given this fact, this proposed amendment, considered only for <br /> what it is, . provides for better consistency between the <br /> Zoning Atlas and the Comprehensive Plan while still <br /> acknowledging the importance of nearby natural areas. <br /> • <br /> • <br /> 1 <br />
