037 <br /> (d) A permit for an Oil Refining Facility <br /> 410 (administered by the North Carolina Division of <br /> Environmental Management); and/or <br /> 2.2.6 Require Environmental Documentation by a State or <br /> Federal agency. <br /> 2.2.7 Require a Special Use Permit, Site Plan, or <br /> Subdivision approval, and are located within, or <br /> • contain one or more of the following environmentally <br /> sensitive areas: <br /> (a) The Water Quality Critical Area of the Water <br /> Supply Watershed, as defined in the Land Use <br /> component of the Orange County Comprehensive <br /> Plan; and/or <br /> (b) Sites identified in "An Inventory of Sites of <br /> Cultural, Historic, Recreational, Biological, <br /> and Geological Significance in the <br /> Unincorporated Portions of Orange County" or <br /> "Inventory of the Natural Areas and Wildlife <br /> Habitats of Orange County, North Carolina" ; <br /> and/or <br /> • (c) Lands with slopes in excess of 25% outside of <br /> drainage easements or stream buffers, as <br /> determined by USGS Topographic maps, at a <br /> contour interval of 10 feet. <br /> The Environmental Assessment (EA) shall consist of a document <br /> designed by the Planning Department and completed by the <br /> applicant. Upon completion, the EA will address the <br /> environmental issues of County concern. If the EA reveals no <br /> "significant environmental impacts", as that term is defined <br /> in this ordinance, the Planning Department shall issue a <br /> Finding of No Significant Impact (FONSI) . <br /> 2.3 Environmental Impact Statement <br /> For projects which require submittal of an Environmental <br /> Assessment, an Environmental Impact Statement (EIS) will also <br /> be required if the project has a significant environmental <br /> impact. A project has a significant environmental impact <br /> when it : <br /> 2.3.1 Involves a Mining Permit, or extractive activity <br /> 411 which requires removal of surface or sub-surface <br /> material in excess of 40,000 cubic feet, excluding <br /> roads: and/or <br /> MH-3 <br />
