Verner and Mr. Berl Bernhard in <br /> connection with the proposed rezoning of Duke Forest <br /> Lands lying in Orange County. My clients own approximately <br /> 90 acres adjacent to the Duke Forest Land in the vicinity <br /> of Old NC Route 86 within the Boling Creek Basin. <br /> Last year action was taken by various governing boards <br /> in Orange County providing for my clients' property extending <br /> 400 feet from Duke Forest on a frontage of approximately <br /> 2550 feet to remain in the Rural Buffer Zone and further <br /> providing that a 100 foot natural buffer extend from the <br /> Duke Forest border on each new lot in my clients' property <br /> adjacent thereto. There were further provisions that the <br /> 100 foot buffer may be disturbed only when necessary to install <br /> a ground absorption sewage disposal system. <br /> \ In connection with the public hearing to be held tonight, <br /> 1 I talked with the Orange County Planning Department and also <br /> the Orange County Attorney seeking information as to the <br /> effect that the proposed rezoning ordinance would have on <br /> my clients' property. It is my understanding from these <br /> ] conversations that the proposal calls for Duke Forest Property <br /> lying adjacent to the Verner/Bernhard property to be rezoned <br /> PID No. 1 and that the impact on the use of my clients' property, <br /> \ if this ordinance were to be adopted, would not be more <br /> restrictive than the present ordinance. <br /> I If I am incorrect in these assumptions or if as a result <br /> of information developed at this public hearing a more <br /> restrictive use is to be considered, I respectfully request <br /> an Opportunity to be heard on behalf of my clients prior <br /> to any final action being taken with respect to any rezoning <br />
