JAN 30 '89 17:06 DIVISION OF STATE LIBRARY 605 P03
«aCa'
Nik
North Carolina Department of Cultural Resources
James C.Martin, Governor Division of Archives and History
Patric Dorsey,Secretary William S.Price,Jr., Director
January 30, 1989
Mr. Moses Carey, Jr., Chairman
Orange County Commissioners
Courthouse
106 East Margaret Lane
Hillsborough, N.C. 27278
Re: Proposed Orange County Reservoir
ER 89-7914
Dear Chairman Carey:
Recently we received from one of your constituents notification of a
public hearing on a proposed Orange County reservoir either on the Eno
River above McCowan Creek or on Seven Mile Creek. Because a federal
permit from the Army Corps of Engineers is necessary for a dam at either
site, we would like to inform you of the county's and Army Corpse
responsibilities for archaeological, architectural, and historical
properties under Section 106 of the National Historic Preservation Act.
Section 106 requires that federal agencies take into consideration the
potential effects of a proposed undertaking on all significant historic
properties early in the planning process. For purposes of the act and
under the regulations of the Advisory Council on Historic Preservation
(36 CFR 800), historic properties include all sites, structures, objects,
or districts which are listed in or are eligible for listing in the
National Register of Historic Places. At this time the proposed project,
if located above McGowan Creek, would appear to affect k'eucettees Mill,
Chatwood, Little Ayr Mount, and the Elms. In addition to these known
historic properties, there is a high probability for archaeological
sites within the project area. As part of the planning and Section 106
process, it will be necessary for the county to identify and evaluate
all historic properties that may be affected by project.
the e
ct.
Once these properties are identified and evaluated in terms of the
National Register criteria, plans to avoid adversely affecting the
properties or reducing potential adverse effects must be considered in
consultation with the State Historic Preservation Officer. For your
information and future reference we are enclosing a copy of the regula-
tions of the Advisory Council on Historic Preservation and a pamphlet
which explains each step in the Section 106 process.
