a. The Joint Planning Area; or 10 <br /> b. A Water Ouality Critical Area., <br /> Within the Rural Buffer portion of the Joint <br /> Planning Area and within a Water Ouality Critical <br /> Area, further extensions of system lines will only <br /> be permitted to provide, service for one of the <br /> three reasons stated above. <br /> All water and sewer system facilities extended into <br /> the Rural Buffer portion of the Joint Planning Area <br /> or into a Water Ouality Critical Area shall be <br /> sized to address, only the concern for which the <br /> systems are extended. <br /> 3. Within areas outside of Transition Areas not within <br /> the Rural Buffer portion of the Joint Planning Area <br /> or not within a Water Quality Critical Area, public <br /> water and sewer will only be extended to provide <br /> service to: (a) an essential public service (such <br /> as a school) j (b) correct a public health <br /> emergenc (failing septic, tank or failing package <br /> treatment plant, neither of which can be corrected; <br /> or igl land where the failure to provide public <br /> water and sewer will result in the landowner's <br /> inability to use the land for any reasonable <br /> purpose (resulting j , and a constitutional <br /> "taking") . <br /> Development projects may be supplied by public <br /> water and sewer service in areas outside the Rural <br /> Buffer portion of the Joint Planning Area and <br /> outside a Water Ouality Critical Area when service, <br /> to the project, j , at the site. Provided, <br /> howeyer, _any such development project will, only be <br /> approved at densities permitted hy the Orange <br /> County Zoning Atlas and consistent with the Land <br /> Use Element, of the Comprehensive Plan. <br /> • All water and sewer facilities extended pursuant to <br /> this policy statement will be sized according to <br /> the policies of the public utility providing the <br /> water and sewer services. <br /> "Development project" refers to any residence, <br /> place of business or place of assembly, and any <br /> major or minor subdivision, special use or planned <br /> development which requires the approval of Orange <br /> County through administration and enforcement of <br /> the N.C. State Building Code or its Zoning and <br /> Subdivision Regulations. <br /> 13 <br />
