. <br /> 8. Information and Reports. The Consultant shall, at such time and in such form as <br /> the County may require,furnish periodic reports concerning the status of the project and <br /> other information relative to the project as may be requested by the County. <br /> 9. Indemnification. Consultant shall indemnify, defend and hod o such claims or <br /> County from and against all claims and actions,and all expenses incidental <br /> actions,based upon or arising out of damage to property or injury to persons or other tor- <br /> tious acts caused or contributed to by Consultant or anyone acting under its direction or <br /> control or in its behalf in the course of its performance under this Agreement,provided the <br /> Consultant's aforesaid indemnity and hold harmless agreement shall not be applicable to <br /> any liability based upon the sole negligence of the County. <br /> 10. Governing Iaw. The laws of North Carolina shall govern the validity and inter- <br /> pretation of the terms and conditions of this Agreement, subject matter thereof and has <br /> been induced by no representations, statements or agreements other than those herein <br /> expressed.
