Presently, the Ordinance implies that <br /> obtaining a Grading Permit extends the validation of the plan <br /> approval. To avoid this confusion, the Ordinance would be <br /> amended as above. This change would apply to plans approved <br /> after adoption of the amendment. <br /> Approvals and permits should be valid for a reasonable period <br /> of time to allow the holder to obtain all the necessary <br /> approvals and permits required before beginning the <br /> disturbance. In some instances this may require many months <br /> while detailed engineering plans are made and approved. <br /> These changes would apply to erosion control plans approved <br /> after adoption of the amendments. <br /> The land disturbing activity is considered to have <br /> started when the necessary erosion control practices have <br /> been properly installed and the site clearing or grading <br /> has begun. <br /> e. The County may establish such fees as considered <br /> necessary to defray costs of administering this <br /> ordinance. <br /> f. Pursuant to G.S. Section 153A-357, no building pAralt <br /> shall be issued unless a_n, erosion control, plan has been <br /> approved, where such approval is Eggnirkiit„ for the site <br /> of the activity or a tract of land including the site of <br /> the activity. <br /> COMMENTARY: Paragraph f. is will be added in response to <br /> changes in State statutes. This change will be effective <br /> January 1, 1989. <br /> Whenever a person conducting a land-disturbing activity <br /> is not complying with the provisions of this ordinance, <br /> the Grading Permit, the Approved Erosion Control Plan or <br /> any amendments to the Plan, the Erosion Control Officer <br /> may revoke the Grading Permit for the site. Notice of <br /> Revocation shall be sent by registered or certified mail <br /> to the person conducting the land-disturbing activity. In <br /> the event delivery cannot be accomplished by registered <br /> or certified mail, it may be accomplished in any manner <br /> provided in Rule 4 (j) of the North Carolina Rules of <br /> Civil Procedure. Upon receipt of the Revocation Notice, <br /> the person responsible must immediately order all land- <br /> disturbing activities to cease except those which are <br /> specifically directed towards bringing the site into <br /> compliance. Once the site has been inspected and remedial <br />
