1 <br /> ORANGE COUNTY <br /> BOARD OF COMMISSIONERS <br /> ACTION AGENDA ITEM ABSTRACT <br /> Meeting Date January 14_ 1989 <br /> Action Agenda <br /> Item if <br /> SUBJECT: WORK_PGAN/ZONING.HISTORY - JOHNNY-KENNEDY PROPERTY <br /> DEPARTMENT: PLANNING PUBLIC BEARING Yes _x_N0 <br /> ATTACHMENT(S) : INFORMATION CONTACT: <br /> 12-29-88 Planning Director Planning Director - Extension 346 <br /> Memorandum <br /> TELEPHONE NUMBERS: <br /> Hillsborough - 732-8181 <br /> Durham - 688-7331 <br /> Mebane - 227-2031 <br /> Chapel Hill - 967-9251 <br /> PURPOSE: To consider information requested at the December 20 <br /> meeting relative to the proposed rezoning of Mr. <br /> Johnny Kennedy's property from GC-4 to EC-5. <br /> BACKGROUND: Recently adopted Comprehensive Plan amendments for Eno <br /> Township and staff-initiated rezonings to promote <br /> consistency with the Land Use Element could possibly <br /> make Mr. Kennedy's business operations on lots 24, <br /> 24A, and 24B, tax map 25, nonconforming. <br /> At the Commissioners meeting on December 20, Mr. <br /> Kennedy's attorney, Cyrus Hogue, questioned the <br /> propriety of rezoning Mr. Kennedy's property, since it <br /> was his understanding that the property was in the <br /> activity node. A repesentative of the Planning Staff <br /> stated that the property never had been in the <br /> activity node. The Commissioners asked for further <br /> clarification on the history of the node. <br /> Mr. Hogue also stated that the EC-5 zoning district <br /> was not consistent with Mr. Kennedy's business and <br /> would not permit expansion. The Board asked staff to <br /> investigate possible amendments to the table of <br /> permitted uses for the EC-5 district which would <br /> address these concerns. <br /> The Planning Staff has responded to the Commissioners <br /> concerns through the attached 12-29-88 memorandum to <br /> the County Manager. <br /> RECOMMENDATION: Receive as information. <br />
