' I <br /> 4 <br /> PROPOSED AMENDMENTS TO THE <br /> ORANGE COUNTY <br /> EROSION CONTROL ORDINANCE <br /> The Erosion Control Division staff is proposing that the <br /> following changes be made to the Ordinance. These changes <br /> address administrative procedures, making the proposed Soil <br /> Erosion and Sediment Control Manual the standards for Orange <br /> County, and other amendments to the State's Ordinance that <br /> were recently adopted. <br /> The underlined text will be added to the Ordinance and the <br /> text that is marked through will be deleted. Brief <br /> commentaries are included in italics to explain each change. <br /> Section 5 Exclusions (County-wide) <br /> This ordinance shall apply to land disturbing activities <br /> undertaken by any person, with the following exclusions: <br /> a. Those undertaken on agricultural land for the production <br /> of plants and animals useful to man, including but not <br /> limited to: forages and sod crops, grains and feed crops, <br /> tobacco, cotton, and peanuts; dairy animals and dairy <br /> products; poultry and poultry products; livestock, <br /> . including beef cattle, sheep, swine, horses, ponies, <br /> mules or goats, including the breeding and grazing of any <br /> or all such animals; bees and apiary products; fur• <br /> animals; <br /> b. Those undertaken on forestland for the production and <br /> harvesting of timber and timber products. <br /> C. Activities undertaken by persons as defined in G.S. <br /> 113A-52(8) who are otherwise regulated by the provisions <br /> of G.S. 74-46 through G.S. 74-68, the Mining Act of 1971. <br /> d. Those land-disturbing activities over which the State by <br /> statute, has exclusive regulatory jurisdiction, which are <br /> activities: <br /> (1) Conducted by the State, <br /> (2) Conducted by the United States, <br /> (3) Conducted by persons having the power of eminent <br /> domain, <br /> (4) Conducted by local governments, <br /> - - <br /> (6) J . Funded in whole or in part by the State or the <br /> United States. <br />
