, 3 ‹ <br /> PROPOSED ORDINANCE AMENDMENT <br /> ORDINANCE: Subdivision Regulations <br /> REFERENCE: Section IV-B-10 Cluster Developments <br /> ORIGIN OF AMENDMENT: Staff X Planning Board <br /> BOCC Public <br /> Other: <br /> STAFF PRIORITY RECOMMENDATION: X High Middle Low <br /> Comment: Minor Amendment <br /> Expected Public Hearing Date: November 28, 1988 <br /> PURPOSE OF AMENDMENT: To amend Section IV-B-10 of the <br /> Subdivision Regulations by limiting <br /> the amount of required open space <br /> designated for uses which prohibit <br /> access by the residents of a cluster <br /> subdivision. <br /> IMPACTS/ISSUES: During the last eighteen months, several <br /> cluster subdivision applications were sub- <br /> mitted which proposed uses of the common <br /> open space such as nitrification fields for <br /> sewage disposal and/or stormwater detention <br /> which would be resticted for access. Access <br /> restrictions usually apply where safety or <br /> soil compaction is a concern. <br /> As the Planning Board reviewed the subdivi- <br /> sions, they questioned whether sewage <br /> disposal was an appropriate use for the <br /> common recreation/open space, especially in <br /> situations where the majority of the common <br /> area was restricted for use by the resi- <br /> dents. <br /> EXISTING ORDINANCE PROVISIONS: <br /> IV-B-10-e Approval of Preliminary Plan <br /> (h) At least twenty percent of the gross land area <br /> is designated as common open space. <br />
