Article 4 - Permitted Uses, Article 8 - Special Uses and <br /> Ell> <br /> Article 22 Definitions (Day care Facilities) <br /> The presentation was made by Marvin Collins. <br /> These proposed amendments would revise existing <br /> provisions applicable to day care facilities to be <br /> consistent with State licensing requirements. <br /> Day care, day nursery, and kindergarten facilities of <br /> all types are currently permitted in residential zoning <br /> districts upon approval of a Class B Special Use Permit. <br /> In commercial and office zoning districts, such <br /> facilities are permitted by right. <br /> It has been brought to the attention of the Planning <br /> Department that erroneous information was provided to <br /> the Child Care Networks 4 1/2 years ago. The <br /> information provided indicated that no permits of any <br /> kind were required for such facilities. For this reason, <br /> permits have not been obtained by those facilities <br /> within Orange County's jurisdiction. <br /> Another concern identified by staff of Child Care <br /> Networks is the inconsistency between State licensing <br /> requirements and the permit requirements of Orange <br /> County. The State requires that day care facilities of <br /> a certain size and operating certain hours be licensed, <br /> whereas Orange County requires that all such facilities <br /> in residential areas be required to obtain a Class B <br /> • Special Use Permit. The staff of Child Care Networks <br /> has recommended that Orange County's zoning provisions <br /> be amended to be consistent with-the- State licensing <br /> requirements. <br /> The proposed amendments incorporate the definitions of <br /> "day care" and "day care facility" from the State <br /> . . __ licensing requirements into the Zoning Ordinance. The <br /> zoning Districts in which day care facilities are <br /> permitted, by right and upon approval of a Class B . <br /> Special Use Permit, would remain unchanged. . <br /> -- - - The standards for evaluation of a Special Use Permit - <br /> application have been proposed for amendment. The <br /> proposed changes would include the following: <br /> a) The day care facility is to be located in an area <br /> which is free from conditions dangerous to the <br /> physical and moral welfare of the children. <br /> b) The minimum requirements to qualify for a State of <br />
