6 <br /> --- <br /> PROPOSED ORDINANCE AMENDMENT <br /> ORDINANCE: Zoning Ordinance <br /> REFERENCE: Articles 4, 8, and 22 <br /> ORIGIN OF AMENDMENT: X Staff Planning Board <br /> --BOCC X Public <br /> Other: <br /> STAFF PRIORITY RECOMMENDATION: X High Middle Low <br /> Comment: <br /> EXPECTED PUBLIC HEARING DATE: November 28, 1988 <br /> PURPOSE: To revise existing Zoning Ordinance provisions <br /> applicable to day care centers to be consistent with <br /> State licensing requirements. <br /> IMPACTS/ISSUES: Day care, day nursery, and kindergarten <br /> facilities of all types are currently <br /> permitted in residential zoning districts <br /> upon approval of a Class B Special Use <br /> Permit. In commercial and office zoning <br /> districts, such facilities are permitted by <br /> right. <br /> It has been brought to the attention of the <br /> Planning Department that erroneous <br /> information was provided to the Child Care <br /> Networks 4-1/2 years ago. The information <br /> provided indicated that no permits of any <br /> kind were required for facilities other than <br /> those requiring State licensing. For this <br /> reason, permits have not been obtained by <br /> those facilities within Orange County's <br /> jurisdiction. <br /> Another concern identified by staff of Child <br /> Care Networks is the inconsistency between <br /> . State licensing requirements and the permit <br /> requirements of Orange County. The State <br /> requires that day care facilities of a <br /> certain size and operating certain hours be <br /> licensed, whereas Orange County requires that <br /> all such facilities in residential areas be <br /> required to obtain a Class B Special Use <br /> Permit. The staff of Child Care Networks has <br /> recommended that Orange County's zoning <br /> provisions be amended to be consistent with <br /> the State licensing requirements. <br />
