31 7 <br /> Commercial-5. <br /> The Planning Board will prepare a recommendation on the <br /> proposed amendment at its December 19, 1988 meeting. <br /> The Board of Commissioners will consider the proposal <br /> for decision on January 3, 1989. <br /> Commissioner Hartwell asked whet benefit this rezoning <br /> would have for the applicant. Crudup responded that <br /> there are existing commercial structures, warehouses, on <br /> the property. The use proposed by the applicant is not <br /> allowed in CC-3 but is allowed in EC-5. The rezoning <br /> would make it consistent with the Land Use Plan since <br /> the node was removed when the Joint Planning Area Land <br /> Use Plan was adopted in October 1986. <br /> Planning Board member, Steve Yuhasz, asked why the EC-5 <br /> designation was not assigned at the time the node was <br /> removed. Crudup responded that it was an oversight at <br /> the time and should have been EC-5. Yuhasz asked about <br /> buffer requirements. Crudup responded that the • <br /> landscape requirements are very similar for EC-5 and <br /> CC-3. <br /> Motion was made by Commissioner Hartwell, seconded by <br /> Commissioner Marshall to refer Z-5-88 to the Planning Board for a <br /> recommendation to be brought back to the Board of Commissioners no <br /> sooner than January 3, 1989 . <br /> VOTE: UNANIMOUS. <br /> b. Z-6-88 Dale G. Davis <br /> The presentation was made by Eddie Kirk. <br /> The property in question is located on the north side of <br /> US Highway 70 approximately 385 feet west of the <br /> intersection with Buckhorn Road (SR 1114) . The <br /> applicant, Dale G. Davis, is requesting a rezoning om <br /> Lot 9 of Tax Map 25 - Cheeks Township. The property <br /> proposed to be rezoned contains 51.712 square feet or <br /> 1.19 acres. The current zoning on the property is R-1 <br /> (Rural Residential) and PW II (Protected Watershed) . <br /> The proposed rezoning is EC-5 (Existing Commercial) and <br /> PW II (Protected Watershed) . <br /> The area is designated as 10 Ten Year Transition in the <br /> Land Use Plan. The applicant indicates that the <br /> existing use was in operation in 1984 when Cheeks <br /> Township was zoned. The existing commercial building is <br /> located on two lots and the lot line runs through the <br /> building. Only one of these lots was zoned commercial <br /> in 1984. The applicant is requesting the other lot be <br /> rezoned to allow the building to become conforming. <br /> The Planning Staff recommends approval of the proposed <br />
